The Truth is Not a Defense.

If not why not?

At any rate that's what an attorney thinks. Imagine that. An officer of the law doesn't think very highly of the truth.

Being a lawyer and all....

Interesting. The attorney is, of course, wrong but, on the other hand, and as pointed out in the comments, simply filing a defamation lawsuit places a burden on the defendant. Additionally, should the defendant fail to mount any defense at all, due to lack of funds or any other of a number of reasons, it's possible that a judge might find in favor of a police chief. Stranger things have happened.

The poor people are at an inherent disadvantage.

That description is as accurate as I've heard. The average person, faced with a civil suit, even, or maybe especially, a frivolous one, has little chance of properly defending themselves.

One of these days, should we ever sit across the table from one another, you might be interested to hear what a nightmare of "justice" my sister found herself in when she filed a restraining order to protect herself and her son from her wealthy ex.

She prevailed but not without considerable expense and intestinal fortitude.
